Regulations for the provision of electronic services

via the online store www.wysoccy.com.pl

1. GENERAL PROVISIONS.

1.1. These regulations (hereinafter: "Regulations") define the rules for the provision of electronic services by a general partnership under the name: P. H. Wysoccy Spółka Jawna based at ul. Kwiatowa 18a, 94-238 Łódź, NIP number: 7272286534,

  REGON No.: 471639711 (hereinafter referred to as: "P.H. WYSOCCY SP.J." or the "Service Provider").

1.2. P.H. WYSOOCCY SP.J. is a Service Provider within the meaning of Art. 2 point 6 of the Act of July 18, 2002 on the provision of services by electronic means (consolidated text: Journal of Laws of 2017, item 1219, hereinafter: uś.u.d.e.), providing services electronically via the website www.wysoccy .com.pl.

1.3. Whenever the "User" is mentioned in the following sections of the Regulations, it should be understood as the Service Recipient within the meaning of Art. 2 point 6 of u.ś.u.d.e. - i.e. an entrepreneur: both a natural person running a business and commercial law companies regulated in the Act of September 15, 2000, Commercial Companies Code (a legal person or an organizational unit without legal personality), which, after completing the registration and account verification procedure, use from the services provided by P.H. WYSOOCCY SP.J. via the website www.wysoccy.com.pl.

1.4. These Regulations apply only to entrepreneurs offered wholesale by P.H. WYSOOCCY SP.J. The Regulations do not apply to persons who are consumers within the meaning of Art. 221 of the Act of April 23, 1964, Civil Code (consolidated text: Journal of Laws of 2017, item 459), i.e. performing legal transactions not directly related to their business or professional activity (retail sales). P.H. WYSOOCCY SP.J. conducts retail sales to consumers only through stationary sales points located in:

2. REGISTRATION.

1. Starting to use the services provided via the website www.wysoccy.com.pl. requires the User to create an individual account. The user can select the language from the drop-down list next to it: PL – Polish language; EN – English language; RU - Russian language. Registration is done by clicking on the "Register" button in the upper right corner of the page. Before proceeding with further activities, the User selects whether he or she is an entrepreneur registered in Poland, another country within the territory of the European Union or outside the European Union. Selecting one of the options displays the appropriate registration form, which the User completes in order to create an account in the Service Provider's system.

 

2.1. REGISTRATION PROCEDURE FOR ENTREPRENEURS REGISTERED IN POLAND.

2.1.1. In the registration form, the User must provide the Tax Identification Number - NIP (without separating the number with dashes). A user can only create one account with the same NIP number. The system allows you to automatically complete the entrepreneur's data from the Central Statistical Office database after entering the NIP number.

In case of problems with automatic data download from the Central Statistical Office database, the User will proceed to the form in which he must provide basic personal, address and business data.

2.1.2. Then you need to check the box: "I accept the Regulations". After clicking "I accept the Regulations", a new tab will be opened in the web browser with the content of these Regulations and the option to generate it as a PDF file. Accepting the regulations is a necessary condition for further account registration and provision of services by P.H. WYSOOCCY SP.J.

2.1.3. The user must check the box: "I consent to the processing of my personal data by P.H. WYSOOCCY SP.J. ", after clicking on the inscription: "More information", full information about the data controller, the scope, purposes of personal data processing and the rights of the data subject is displayed. The content of the information is indicated in points 6.4 - 6.15. these Regulations. Consent is voluntary, but it is a necessary condition for further account registration and provision of services by P.H. WYSOOCCY SP.J.

2.1.4. The user must enter the e-mail address used to verify the created account and subsequent electronic correspondence in order to place and complete the order.

2.1.5. In the "Password" field, the User must enter a password of his/her own origin, which must consist of at least 6 characters. The entered password must be repeated in the "Repeat password" field.

2.1.6. In the "Company Name" field, enter the full name under which the User conducts business activity, consistent with the entry in the appropriate register - CEIDG or KRS.

2.1.7. In the "Telephone" field, the User must enter a telephone number that will enable contact with the entrepreneur to confirm the submission and execution of the order.

2.1.8. In the fields: "City", "Postal code", "Street", "Building number", "Apartment number" - the User must enter the address details of the place of business where the ordered goods will be sent.

2.1.9. After clicking the "Register" button again, you will see information that the system has automatically sent a message to the previously provided e-mail address, containing an activation link to the User's created account. An e-mail with the subject: "Registration" is sent from the following address: zamowienia@wysoccy.com.pl. After receiving it, click on the activation link.

2.1.10. After verifying the correctness of the entered data and the fact of running a business and being an active payer of the goods and services tax (VAT), the system will send another e-mail with the title: "Activation" from the address: zamowienia@wysoccy.com.pl, informing about the successful completion activation of the User's individual account.

2.1.11. The user can now log in to their individual account by clicking the "Log in" button in the upper left corner on the website www.wysoccy.com.pl, entering their e-mail address and the received password. At this point, the User can fully use the online store and start placing an order.

2.1.12. The provision of services electronically by the online store www.wysoccy.com.pl, in the form of the possibility of placing orders for goods and mutual contact by electronic means and by telephone between the seller and the buyer, is free of charge.

2.1.13. The User may terminate the use of the service provided electronically at any time by sending an e-mail to the following address: zamowienia@wysoccy.com.pl with information about such a request.

 

2.2. REGISTRATION PROCEDURE FOR ENTREPRENEURS REGISTERED IN A COUNTRY OTHER THAN POLAND, BELONGING TO THE EUROPEAN UNION.

2.2.1. In the registration form, the User must provide the Tax Identification number (VAT EU, NIP EU) along with the country code (e.g. DE, DK) without separating the number with dashes. A user can only create one account with the same VAT number. The system allows you to automatically verify the correctness of the entered tax identification number.

2.2.2. The user will proceed to the form in which he must provide basic personal, address and business data.

2.2.3. Then you need to check the box: "I accept the Regulations". After clicking "I accept the Regulations", a new tab will be opened in the web browser with the content of these Regulations and the option to generate it as a PDF file. Accepting the regulations is a necessary condition for further account registration and provision of services by P.H. WYSOOCCY SP.J.

2.2.4. The user must select the box (i.e. checkbox): "I consent to the processing of my personal data provided in the form by P.H. WYSOOCCY SP.J. ", after clicking on the inscription: "More information", full information about the data controller, the scope, purposes of personal data processing and the rights of the data subject is displayed. The content of the information is indicated in points 6.4 - 6.15. these Regulations. Consent is voluntary, but it is a necessary condition for further account registration and provision of services by P.H. WYSOOCCY SP.J.

2.2.5. The user must enter the e-mail address used to verify the created account and subsequent electronic correspondence in order to place and complete the order.

2.2.6. In the "Password" field, the User must enter a password of his/her own origin, which must consist of at least 6 characters. The entered password must be repeated in the "Repeat password" field.

2.2.7. In the "Company Name" field, enter the full name under which the User conducts business activity, consistent with the entry in the relevant business register.

2.2.8. In the "Telephone" field, the User must enter a telephone number that will enable contact with the entrepreneur to confirm the submission and execution of the order.

2.2.9. In the fields: "City", "Postal code", "Street", "Building number", "Apartment number" - the User must enter the address details of the place of business where the ordered goods will be sent.

2.2.10. After clicking the "Register" button again, you will see information that the system has automatically sent a message to the previously provided e-mail address, containing an activation link to the User's created account. An e-mail with the subject: "Registration" is sent from the following address: zamowienia@wysoccy.com.pl. After receiving it, click on the activation link.

2/2/11. 2.2.12. The user can now log in to their individual account by clicking the "Log in" button in the upper left corner on the website www.wysoccy.com.pl, entering their e-mail address and the password they created. At this point, the User can fully use the online store and start placing an order.

2.2.13. The provision of services electronically by the online store www.wysoccy.com.pl, in the form of the possibility of placing orders for goods and mutual contact by electronic means and by telephone between the seller and the buyer, is free of charge.

2.2.14. The User may terminate the use of the service provided electronically at any time by sending an e-mail to the following address: zamowienia@wysoccy.com.pl with information about such a request.

3. ORDER OF GOODS.

3.1. After the User logs in to the individual account in the online store www.wysoccy.com.pl, he or she selects the products that interest him or her via the drop-down menu on the left and then by clicking on the product photo. The subpage of a specific product contains its detailed description, including: type/type of product, composition of materials from which it is made, number of pieces of a single product in one package.

3.2. In order to order a product, you must select the number of packages and then click the "Add to cart" button, after which the User is automatically redirected to the page showing his shopping cart. At this point you can still change the selected quantity of the product. If you select a quantity of a given product that is not in stock, the following message will be displayed: "Quantity not immediately available. Reduce the quantity to X pieces or contact the seller. The message indicates the maximum quantity of the product available. The condition for processing an order in excess of the quantity indicated in the message is the availability of the goods in the warehouse.
If you are interested in ordering a larger quantity of the product, the User must contact the seller by phone at +48 882-457-129 or send an e-mail to amwysoccy@op.pl.

3.3. To remove a selected product from the cart, click the red button with a cross (when you hover the cursor over this button, the text "Remove" is displayed). The user can convert the value of selected products by clicking the "Convert" button.

3.4. The minimum value for which the User must place a single order - consisting of one or several products - is PLN 300 net. If this amount is not reached, the following information will be displayed at the bottom of the basket: "The minimum order value is 300.00 net". After adding products whose net value exceeds PLN 300 to the cart, the "Place an order" button will appear. When describing a specific product in detail, unit packaging prices are given in net and gross amounts. When summarizing the order, the basket contains unit prices, the total price of the selected quantity of a given product in net and gross amounts, and the total price of the entire order (all products) in net and gross amounts.

3.5. After clicking the "Place an order" button, the User must select the method of delivery of the goods by selecting from the drop-down menu:

a) "Courier" - the shipment will be made via DPD

The shipping cost when choosing this method of delivering the goods is:

- for orders over PLN 1000 gross, shipping is PLN 0.

- for orders below PLN 1000 gross, shipping is PLN 24.60 gross.

- foreign shipment EUR 14 gross (up to 30 kg)

b) "Personal collection (Ch. Ptak)" - collection at the Ptak Shopping Center, ul. Żeromskiego 6, 95-030 Rzgów near Łódź, western passage, station no. 28, tel: 42-236-28-78, +48 697-240-328.

Opening hours: Monday, Wednesday, Friday 7:00-14:00; Saturday: 9:00-14:00: Tuesday, Thursday: 8:00-14:00, commercial Sunday 8:00-14:00.

c) "Personal collection (MUNICIPAL BAZAR Tuszyn)" - collection at the Shopping Center in Tuszyn, ul. Jana Pawła II 70, 95-080 Tuszyn. Tel +48 882-457-129.

Opening hours: Monday - Friday 7:00 - 15:00; Saturday – closed, Sunday 8:00 a.m. - 2:00 p.m.

3.6 In the "Comments" field, the User can enter:

a) the date when he would like to collect the goods in person at the selected place or when he would like the courier to come to him. If there is no indication of the deadline for performance, the principle set out in Art. 457 of the Civil Code, i.e. the goods will be sent at the earliest possible date, but no earlier than 4 business days after the payment is recorded in the case of mail order sales; In the case of personal collection, it is necessary to place the order no later than 2 business days before the planned collection date.

b) specific requirements regarding the packaging of the ordered goods, otherwise the goods will be packed standardly, i.e. glued cartons, wrapped and secured with stretch foil and Marilyn brand tape.

c) a different address for shipping the goods than the one provided in the registration process. The address can also be changed, but no later than within 3 hours (in words: three) after placing the order, by notifying about it by phone or sending an e-mail to the following address: zamowienia@wysoccy.com.pl. A different address for shipping the goods must be indicated each time an order is placed.

In the "Comments" field, the User may not enter illegal content within the meaning of generally applicable law.

3.7. Then, the User must select the method of payment for the ordered goods by selecting from the drop-down menu:

a) "Cash on delivery" - payment for the purchased goods should be made to an employee of P.H. WYSOOCCY SP.J. at the selected collection/sales point or to the courier, who issues a consignment note containing all necessary data as confirmation. In both cases, payment is accepted only in cash.

b) "Transfer (Invoice - Proforma)" - payment is made via the Customer's bank account to the following details and bank account number:

3.9. After 30 minutes of inactivity of the User in the system while logged into his or her individual account, he or she will be automatically logged out. If the user did not click the "Place order" button before logging out, after logging in again, the User's basket will be empty and it will be necessary to add products to the basket again.

3.10 After selecting the number of products, shipping and payment method and clicking the "Place order" button, the order is finally placed. The order details are displayed: order number, date, status, delivery method and entered comments, product type, quantity and unit price as well as quantity and total price. At the same time, a message is automatically sent to the User's e-mail address from the address: zamowienia@wysoccy.com.pl with the subject: "Confirmation of order placement", which includes information about the acceptance of the order, its number and the net and gross amount of the order.

The user can check the orders placed and their status in the individual account panel by clicking the "My orders" button and then the "Details" button. The system also allows you to print the order.

3.11. If the User has chosen to have the order delivered via a courier company, the delivery employee may contact the telephone number indicated by the User during the registration process before delivery in order to complete the delivery.

3.12. To the sales contract between P.H. WYSOCCY SP. J. and the User, the Act of March 8, 2013 on payment terms in commercial transactions (consolidated text: Journal of Laws of 2016, item 684) applies.

 

4. COMPLAINTS.

4.1. Complaints regarding the terms of provision of services electronically by the online store www.wysoccy.com.pl, in the form of the possibility of placing orders for goods and mutual contact by electronic means and telephone between the seller and the buyer should be submitted by sending an e-mail to the following address: zamowienia@wysoccy.com .pl. In case of problems with communication via this e-mail address, please submit complaints to: amwysoccy@op.pl. The message must describe exactly what the problem is and, if possible, send screenshots of the computer or phone screen illustrating the reported problem. The Service Provider will make every effort to solve the reported problem as soon as possible, but no later than within 14 days of reporting.

4.2. Complaints regarding products purchased by the User through the online store www.wysoccy.com.pl or in stationary sales points should be reported by the User in the same way as indicated in point 4.1. However, the user should indicate the number and date of the order from which the goods submitted for complaint come from and return the complained goods to the registered office of P.H. WYSOCCY SP. J. at his own expense. If the complaint is upheld, the shipping cost will be refunded.

4.3. The complaint may concern physical (manufacturing) defects of the products sold. P.H. WYSOCCY SP. J. is not the manufacturer of the products sold and does not guarantee quality, referred to in Art. 571 – 581 of the Civil Code. The rights and obligations of the User who is a buyer are specified in detail in the above-mentioned Code - in particular the "Warranty for defects" section - Art. 556 – 576 – relating to entrepreneurs, not consumers.

4.4. In the event of visible damage to the parcel delivered by the courier, the User should report this fact to the courier, who should prepare a report/note to this effect, confirming the physical condition of the parcel and the products inside the parcel.

4.5. To the legal relations between P.H. WYSOCCY SP. J. and the User who is an entrepreneur - including complaint proceedings related to the sale of goods - the Act of May 30, 2014 on consumer rights (consolidated text) does not apply Journal Laws of 2017, item 683).

 

5. TECHNICAL REQUIREMENTS.

5.1. For the proper operation of the online store www.wysoccy.com.pl, the User's equipment must meet the minimum technical requirements:

a) for computers with Windows, Mac OS, Linux operating systems in versions not older than January 2018.

b) for phones with Android, iPhone OS, Windows Moblie, Symbian operating systems with systems up to date no later than January 2018.

5.2. To avoid risks related to the use of the online store www.wysoccy.com.pl, the user should not share the password to his or her individual account with a third party who is not authorized to make declarations of will on his or her behalf. All orders placed from the User's account will be treated as a declaration of will placed on behalf of and for the benefit of the User. The Service Provider is not liable for any damage resulting from the User providing the login and password to a third party.

5.3. In order to provide services electronically, the Service Provider uses software whose purpose is to collect customer orders, invoice, ship goods and send e-mail information regarding the order (e-mail).

5.4 The Service Provider is not responsible for disruptions in the operation of the online store caused by unauthorized interference by Users or third parties who are not dependent on the Service Provider in any way.

5.5 The Service Provider reserves the right to temporarily interrupt the operation of the online store in the event of the need to make changes and improvements to the system and carry out maintenance work or equipment failure or lack of electricity supply. In such a situation, orders may be placed by telephone or at stationary sales points.

 

6. PROCESSING OF PERSONAL DATA.

6.1. The following rules for the processing of personal data apply to data of natural persons - including entrepreneurs conducting business activity as natural persons or data of natural persons who are partners in commercial law companies or members of their bodies.

6.2. The rules for the processing of personal data of natural persons after May 25, 2018 are set out uniformly throughout the European Union by Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter referred to as the GDPR Regulation: https://eur-lex.europa.eu/legal-content/PL/TXT/HTML/?uri=CELEX :32016R0679&from=PL

6.3. The User's personal data are collected by providing them in the form in the process of registering an individual account for the online store www.wysoccy.com.pl.

6.4. Providing your personal data by the User is voluntary, however, it is a necessary condition for completing the registration process, concluding and implementing the contract for the provision of electronic services in order to conclude a contract for the sale of products offered by the store.

6.5. The user should provide his/her real data as an entrepreneur indicated in CEIDG or KRS and also provide a real e-mail address and telephone number enabling direct contact between him and P.H. WYSOOCCY SP.J. The User should update the data provided during registration immediately after any change in these data.

6.6. The administrator of the User's personal data is the Service Provider, whose data are indicated in point 1.1 of these Regulations (hereinafter referred to as: ADO).

6.7. The User's personal data will be processed for the purpose of implementing the concluded contract for the provision of electronic services and the subsequent contract for the sale of goods offered by the www.wysoccy.com.pl store and the related contract for the provision of transport services by an external entity.

6.8. The legal basis for the processing of personal data is Art. 6 section 1 letter a) and b) of the GDPR, i.e. consent of the data subject and performance of the concluded contract.

6.9. In addition to the ADO, the recipient of the User's personal data will be the ADO's employees, external entities with which the ADO has concluded an agreement to entrust the processing of personal data, such as: an accounting office, courier companies, producers of goods sold, external IT services. Personal data will be transferred only for the purposes of providing the services described in these Regulations. The data will not be used for marketing ADO's own products and services.

6.10. The User's personal data will not be transferred to a third country, i.e. outside the EU and the European Economic Area.

6.11. The User's personal data will be processed by the ADO throughout the entire period of using the services provided electronically, i.e. until a request is submitted to discontinue their use (referred to in point 2.15 of these Regulations), and after the end of using the services provided electronically for a period of 2 years, because this is the period of limitation for claims related to the concluded contract for the provision of electronic services and the sales contract (Article 554 of the Civil Code).

6.12. The user has the right to access his or her personal data, the right to request correction, deletion or limitation of the processing of this data, the right to transfer data - on the principles set out in the GDPR regulation.

6.13. The User may withdraw consent to data processing at any time, but this will mean a request to stop using the electronic services provided by the online store. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.

6.14. The system in which the data is processed does not use personal data in any way for automated decision-making regarding the User and does not conduct profiling. User in order to determine his preferences and behavior when using the online store www.wysoccy.com.pl.

6.15. The User has the right to lodge a complaint with the supervisory authority, which is the President of the Personal Data Protection Office (detailed data is available at www.giodo.gov.pl/pl/493) when the User finds that the processing of personal data violates the law, in particular the GDPR Regulation.

 

7. PROTECTION OF INTELLECTUAL PROPERTY.

All content and graphic elements, in particular photos of product packaging, images of people depicted on the products, trademarks, industrial designs posted on the website www.wysoccy.com.pl may be used only for non-commercial purposes related to the normal use of the website. Any commercial use of the content available via the website requires the prior written consent of P.H. WYSOOCCY SP.J. or manufacturer of the goods sold.
